Shipping Fees

Shipping is $19.99 per order for the continental United States.

Shipping Schedule

Cellar 503 shipments are sent out between the 15th and the 20th each month. Your first shipment will be sent to you between the 15th and the 20th of the following month. Shipments may take between five and ten business days to arrive. Due to shipping regulations, we cannot ship to P.O. Boxes.

You may change your address by accessing your account at www.Cellar503.com or by emailing Cellar 503 at [email protected] no later than the last day of the month prior to the next shipment.

Adult Signature Required

Please send your wine to a home or business address where an individual at least 21 years of age is available during regular business hours to sign. By law all alcohol orders require an adult signature for delivery.

Shipping Conditions

During times of inclement weather, extreme heat, or extreme cold, Cellar 503 LLC reserves the right to delay shipments until conditions improve. Please be advised that Cellar 503 LLC is not responsible for items damaged due to extreme weather conditions.

Holding Wine for Pick Up

If you choose to pick up your wine at our monthly Sip 503 events and cannot attend the event, you may pick up your wine at our office at 4407 SW Corbett Ave, Portland, OR - check out our current hours by clicking on the link above. We will hold up to three months of wine for you. After three months, we will contact you to have your wine shipped to you.

We Ship At Your Request

Title to and ownership of wine purchased from this website passes from Cellar 503 LLC to the purchaser in the State of Oregon. The risk of loss for all purchased items also passes from Cellar 503 LLC to the purchaser in the same manner and at the same time title passes to the purchaser. Cellar 503 LLC does not convey or intimate the right of any person to transport beverage alcohol across any state border. The purchaser takes all responsibility for the shipping of his or her wine from Oregon to his or her home state. At the purchaser’s request, Cellar 503 LLC will arrange delivery of the wine. In doing so, Cellar 503 LLC is providing a service to and acting on behalf of the purchaser. By utilizing this service, the purchaser represents that he or she is acting in a manner compliant with his or her state and local laws regarding the purchase, transport and delivery of wine. The purchaser represents that he or she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine, is legally entitled to take quantities ordered, and certifies that he or she is at least 21 years of age. Cellar 503 LLC reserves the right to choose any and all procedures, packaging and transporter of sold merchandise. Cellar 503 LLC assumes no liability for breach of any regulation by the purchaser. Cellar 503 LLC assumes no liability for any misinterpretation of the above provisions.

States We Ship To

Due to state alcohol laws, we are unable to ship wine to every state. We ship into all states where we are legally able. If an order is placed for a state we can not legally ship to we will reach out to inform the customer before issuing a refund.

General

We reserve the right to cancel and/or terminate any user’s account for any violation of these Terms and Conditions or other terms stated on the Cellar 503 site. Any fraudulent behavior, spamming, flaming, excessive use of profanity or abusive language, either on Cellar 503 or any other website in regards to Cellar 503, or while contacting any of our team, will not be tolerated. By using the Cellar 503 site, you accept and agree to be bound by these Terms. If you do not agree to these Terms and Conditions or our Privacy Notice, please do not use the Cellar 503 site.

Sale of Alcoholic Beverages

Cellar 503 LLC does not sell alcoholic beverages to people under the age of 21. By law, an adult signature (at least 21 years of age) will be required upon delivery of all shipments. By using this site you affirm that you are over the age of 21 and that any alcohol you purchase from this site is intended for personal consumption and not for resale. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, Cellar 503 LLC reserves the right to initiate legal action against you as well as contact law enforcement officials regarding any illegal actions.

Billing

Cellar 503 monthly memberships are charged on a monthly basis in increments of $50, $55 or $60 for our 2 bottle clubs, $100, $110 or $120 for our 4 bottle clubs. Billing for monthly memberships takes place on the first day of every month. Billing for quarterly memberships takes place on the first day of the delivery month. By clicking the “I understand and I agree” button, you give Cellar 503 the right to charge the credit card number you provided for services rendered.

Exchanges for Damaged Bottles

You must contact Cellar 503 at 503-897-8013 or [email protected] within seventy-two hours of delivery to report broken, corked or otherwise damaged products to request an exchange. Please replace the cork in the bottle and bring it with you at the time of exchange.

Membership Cancellations

To cancel your Cellar 503 membership, and your next monthly shipment, contact Cellar 503 LLC in writing prior to the 20th day of the previous month by emailing [email protected].

Cellar 503 may cancel your membership and refuse any and all current or future use of Cellar 503 or other services, or any portion thereof, (1) in order to comply with applicable Law, (2) if you provide any information that Cellar 503 determines, in its sole discretion, to be untrue, inaccurate, not current or incomplete (or if the information becomes untrue, inaccurate, not current or incomplete), (3) if Cellar 503 determines, in its sole discretion, that you are using your Cellar 503 membership in a manner not permitted by these Terms of Service, or (4) in other circumstances, as Cellar 503 deems appropriate in its sole discretion.

Reorders

If you love a wine that was included with your shipment, send us an email at [email protected] and we'll let you know if we have some available. If not, we would be happy to put you in touch directly with the winery to place an order for additional bottles.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or related to these Terms and Conditions, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Oregon without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms and Conditions or the Cellar 503 site shall be instituted exclusively in the federal or state courts located in Portland, Oregon. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver and Severability

No waiver of these Terms and Conditions by Cellar 503 shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Cellar 503 to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.

This contract is fully integrated. Any item not specifically mentioned herein is not a part of the agreement.

Information Collection and Use

Cellar 503 LLC is the sole owner of the information collected on this site. We will not sell, share, or rent customer information to any other organization. Cellar 503 LLC’s order forms request data from customers including contact information (such as name, email address, shipping address, and phone number) and financial information (such as credit card number, expiration date, security code, billing address, and billing phone number). This information is used for billing purposes to verify that the customer is of legal drinking age, and for shipping purposes only. If we encounter difficulty when processing an order, we will use this information to contact the customer. This information is harvested from a secure area and stored safely for our customers' protection. If at any time you would like to change or update information in your account, you may do so on the site or by contacting us at 503-897-8013 [email protected].

Credit Card Processing and Security

Purchasing wine club products from Cellar 503 LLC is absolutely safe and secure. In an effort to protect your privacy, Cellar 503 LLC uses the latest technology to keep your personal information safe. Credit card transactions are handled by an accredited third-party financial institution, which receives credit card and other personal information for verification purposes and to process transactions.

Legal Disclaimers

Cellar 503 LLC reserves the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process. Cellar 503 LLC is not responsible and shall not be liable for any injury or damage caused by, or arising from, the consumption of the merchandise sold to its customers.

Modifications

We may, at any time, revise or modify these Terms Conditions or impose new conditions for use of the Cellar 503 sites. Such changes shall be effective immediately upon notice to you, which may be given by any means including, without limitation, posting on the Cellar 503 site. Any use of a Cellar 503 site or receipt of a Cellar 503 shipment by you after such notice shall be deemed to constitute acceptance of such changes.
